Testosterone Lawsuits Move Forward, as Bernstein Liebhard LLP Comments on Most Recent Order Issued in Federal Litigation

Testosterone Allegations
Court documents indicate that more than 1,000 testosterone lawsuits are currently pending in the Northern District of Illinois, where all federally-filed claims involving this class of prescription medications have been consolidated for the purposes of coordinated pretrial proceedings. All of the claims similarly allege that the manufacturers of testosterone replacement therapies concealed the cardiovascular risks allegedly associated with the drugs, including an increased risk of heart attacks, strokes, deep vein thrombosis and pulmonary embolism. Plaintiffs further claim that sales of the drugs were driven by aggressive direct-to-consumer advertising that touted low-T therapy as a remedy for symptoms associated with age related drops in testosterone, an indication for which they have not been approved.
According to court records, the federal testosterone litigation was established in June 2014, roughly six months after the U.S. Food & Drug Administration (FDA) disclosed that it was investigating the cardiovascular side effects potentially associated with testosterone replacement therapy.* On March 3, 2015, the FDA announced that it was mandating that new information be added to the drug’s labels in order to warn patients that testosterone treatment may increase their risk for heart attacks and strokes. In addition, the agency is also requiring testosterone manufacturers to update their product labels to clarify their approved uses, as the drugs are only indicated to treat men who suffer from hypogonadism (low testosterone levels) due to disorders of the testicles, pituitary gland, or brain.
