The Simms Firm, PLC Announces Victory in Alleged Abduction Case

On Tuesday, March 3, 2015 and after approximately 45 minutes of jury deliberation, Attorney Jonathan A. Simms (simmsfirm.com) received a positive verdict for his client, in the case of Commonwealth v. Meziane Touati.

Essentially, the Commonwealth Attorney’s Office was asking a jury to find him guilty of abduction for escorting someone off of his property. We are thrilled that the jury found him not guilty.

The Simms Firm, PLC, a criminal defense law firm, celebrated a victory last week for their client, Meziane Touati, in the case of Commonwealth v. Meziane Touati (Case No. CR14-2074, Arlington County Circuit Court). Attorney Simms’ client was originally charged with abduction and malicious wounding, although the malicious wounding charge was dismissed prior to the beginning of the trial.

According to the court documents, testimony was received from the process server, police officer, Meziane Touati and the apartment building’s property manager. On August 26, 2014, a process server came to the apartment of Mr. Touati to serve him documents. This was the process server’s fifth time coming to the home, after Mr. Touati had repeatedly told him not to come back. “The process server was banging on the door and my client was home with his two daughters. He answered the door with a knife and confronted the trespasser. My client acted reasonably when he escorted the process server down the elevator and out of the building,” said Attorney Simms. According to the court documents, once both Mr. Touati and the process server were out of the apartment building, Mr. Touati released him and they both went immediately to the security guard to discuss the situation. The process server called the police the next day to file charges.

Attorney Simms’ client could have seen up to a five year sentence, as he was facing a felony charge. “Essentially, the Commonwealth Attorney’s Office was asking a jury to find him guilty of abduction for escorting someone off of his property. We are thrilled that the jury found him not guilty,” said Attorney Simms.
