GREENVILLE, S.C., May 8, 2021 /PRNewswire-PRWeb/ -- In his latest piece, Mr. Gagne reviews the statutory and decisional history of South Carolina Code 42-1-400 which sets forth the various tests courts use in determining whether a subcontracted employee qualifies as an "employee" for purposes of receiving workers compensation benefits if an injury arises out of and in the course of employment. In the process he reveals the strengths, weaknesses and inconsistencies of the law as it currently stands. Mr. Gagne suggests that the time might be ripe to clarify and streamline the law and its applications, especially as it pertains to those employees who perform services secondary to the main business of their employer.
Mr. Gagne is a personal injury lawyer with offices in Greenville and Spartanburg, South Carolina. Since 1997 he has represented victims of auto and job-related accidents. In addition to writing, Mr. Gagne regularly produces video lectures on the practice of injury law for the South Carolina Bar and is a Distinguished Faculty Member of the National Business Institute, Continuing Legal Education Division.
