Attorney Deborah P. Gutierrez, founder of Thrive Law PLC, initiated a lawsuit on behalf of her client three years ago in the Superior Court of California County of Los Angeles (Case No. BC550713). The suit alleged that in 2009, OneWest Bank told the homeowner to default on her mortgage loan in order to qualify for a loan modification, under the federal Home Affordable Modification Program (“HAMP”).
According to the homeowner, OneWest kept her in a perpetual cycle of loan modification review with repeated promises that the bank would modify her mortgage loan. After requiring the homeowner to submit one loan modification after another, including providing extensive financial documentation, the homeowner claims, OneWest breached two trial modification contracts and proceeded with the foreclosure of her home.
The suit alleged that OneWest misrepresented facts to the homeowner throughout the review process, including the reasons the bank denied her loan modification applications, and then unexpectedly foreclosed on her home, in violation of a court order. The homeowner alleged that the ordeal caused her to suffer severe emotional distress over the course of many years, including the wrongful eviction from her home.
