Transvaginal Mesh Lawsuits Progress Against American Medical Systems, As Bernstein Liebhard LLP Notes New Order Governing Bellwether Trials
New York, New York (PRWEB) November 14, 2013 -- Transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) filed against American Medical Systems, Inc. continue to move forward in a multidistrict litigation underway in U.S. District Court, Southern District of West Virginia. According to a Pretrial Order issued on November 13th, the Court has now established protocols pertaining to the selection of specific vaginal mesh lawsuits for the proceeding’s third round of bellwether trials. Those bellwether trials will begin on August 19, 2013. (In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325)
“Bellwether trials are extremely important in large, complex litigations, such as those established for transvaginal mesh lawsuits. The outcomes of these trials could provide valuable insight into how juries might rule in similar cases pending against American Medical Systems,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. Firm partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee in the American Medical Systems litigation. Bernstein Liebhard LLP continues to offer free legal evaluations to alleged victims of mesh erosion, pain, infection, scarring, and other serious transvaginal mesh complications.
Vaginal Mesh Lawsuits
According to court documents, the litigation involving transvaginal mesh devices used to treat pelvic organ prolapse and stress urinary incontinence has been building since October 2008, when the U.S. Food & Drug Administration (FDA) issued its first of two Public Health Alert regarding the risk of potentially serious vaginal mesh complications. In 2011, the FDA issued a second alert, warning that it no longer considered injuries associated with the use of pelvic mesh in prolapse repair, including mesh erosion, infection, scarring, and chronic pain, to be rare.
Court filings indicate that American Medical Systems has been named in well over 11,000 transvaginal mesh lawsuits pending in the Southern District of West Virginia. A number of other multidistrict litigations have been established in the same district for vaginal mesh lawsuits filed against other companies. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is also serving on the Plaintiffs’ Steering Committees for proceedings involving Boston Scientific Corp., (MDL No. 2326); C.R. Bard, Inc., (MDL No. 2187), and In re: Ethicon, Inc. (MDL No. 2327).
Mr. Grand has also been named Co-Liaison Counsel in two consolidated litigations established for C.R. Bard and Ethicon vaginal mesh lawsuits that are currently underway in New Jersey’s Atlantic County Superior Court. He was also a member of the trial team on the first Ethicon trial in that proceeding, which ended in March with an $11 million verdict for the Plaintiff. (In re: Pelvic Mesh/Gynecare Litigation, No. 6341-10; In re: Pelvic Mesh Litigation/Bard, No. L-6339-10).
Women who may have been seriously harmed by transvaginal mesh could be entitled to financial compensation for medical bills, lost wages, pain and suffering, and more.
