Transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) filed against American Medical Systems, Inc. continue to move forward in a multidistrict litigation underway in U.S. District Court, Southern District of West Virginia. According to a Pretrial Order issued on November 13th, the Court has now established protocols pertaining to the selection of specific vaginal mesh lawsuits for the proceeding’s third round of bellwether trials. Vaginal Mesh Lawsuits
According to court documents, the litigation involving transvaginal mesh devices used to treat pelvic organ prolapse and stress urinary incontinence has been building since October 2008, when the U.S. Food & Drug Administration (FDA) issued its first of two Public Health Alert regarding the risk of potentially serious vaginal mesh complications. In 2011, the FDA issued a second alert, warning that it no longer considered injuries associated with the use of pelvic mesh in prolapse repair, including mesh erosion, infection, scarring, and chronic pain, to be rare.
Court filings indicate that American Medical Systems has been named in well over 11,000 transvaginal mesh lawsuits pending in the Southern District of West Virginia. A number of other multidistrict litigations have been established in the same district for vaginal mesh lawsuits filed against other companies. Bernstein Liebhard LLP partner, Jeffrey S.
