Transvaginal Mesh Lawsuit Defendant Seeks Removal of Pennsylvania Cases to Federal Litigation, Bernstein Liebhard LLP Reports

Transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) continue to move forward in state and federal courts throughout the U.S., Bernstein Liebhard LLP reports. According to a Notice filed on February 11th by Boston Scientific Corp., the company is seeking the removal of dozens of cases involving its pelvic mesh products from a mass tort proceeding currently underway in the Pennsylvania Court of Common Pleas in Philadelphia. The Notice, which is now pending before the U.S. District Court, Eastern District of Pennsylvania, requests that the docket be transferred to the multidistrict litigation underway in U.S. District Court, Southern District of West Virginia, where Boston Scientific is named a defendant in more than 15,000 vaginal mesh claims. Vaginal Mesh Litigations
According to court documents, all of the transvaginal mesh lawsuits pending against Boston Scientific were filed on behalf of women who allegedly suffered mesh erosion, chronic pain, organ damage and other serious vaginal mesh complications as a result of the company’s surgical mesh devices used to treat pelvic organ prolapse and stress urinary incontinence. Plaintiffs further allege that Boston Scientific failed to adequately test these devices, and did not provide doctors and patients with adequate warning about their risks. Jeffrey S. According to court filings, more than 67,000 transvaginal mesh lawsuits are currently pending in several litigations established in the U.S. District Court, Southern District of West Virginia. Mr. Grand was also appointed Co-Liaison Counsel in two consolidated litigations established for C.R. Bard and Ethicon mesh lawsuits in New Jersey Superior Court. In addition, he served as a member of the plaintiff’s trial team for the state’s first Ethicon trial, which ended in March 2013 with an $11 million verdict for a woman who experienced vaginal mesh complications related to the Gynecare Prolift device.
