Federal Vaginal Mesh Lawsuits Proceed against Boston Scientific, As Bernstein Liebhard LLP Comments on Court’s Latest Ruling

According to a Pretrial Order issued on March 6th, the Court convened a hearing on March 4th to, among other things, consider a Motion filed by plaintiffs which sought to compel Boston Scientific to go forward with the deposition of certain witnesses. Following the hearing, the Court granted the plaintiffs’ Motion and ordered that the depositions go forward as scheduled. Transvaginal Mesh Litigation
Boston Scientific is named a defendant in more than 14,000 transvaginal mesh lawsuits now pending in the Southern District of West Virginia, where Bernstein Liebhard partner, Jeffrey S. All of the claims were filed on behalf of women who allegedly suffered mesh erosion, chronic pain, organ damage and other serious vaginal mesh complications as a result of the company’s devices. Mr. Grand was also appointed Co-Liaison Counsel in two consolidated proceedings established for C.R. Bard and Ethicon mesh lawsuits in New Jersey Superior Court. In addition, he served as a member of the plaintiff’s trial team for the state’s first Ethicon trial, which ended in March 2013 with an $11 million verdict for a woman who experienced vaginal mesh complications related to the Gynecare Prolift device.
