Texas Vaginal Mesh Lawsuit Trial Ends, as Jury Orders Boston Scientific to Pay $73.5 Million to Victim of Obtryx Sling, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) September 10, 2014 -- A jury in Dallas, Texas, has awarded $73.5 million to a vaginal mesh (http://www.injurybeacon.com/transvaginal-mesh/) plaintiff who was seriously injured by Boston Scientific Corp.’s Obtryx Sling, Bernstein Liebhard LLP reports. According to court document, the jury returned its verdict the same day deliberations began, finding that the Obtryx device was defectively designed, and that Boston Scientific failed to provide adequate warnings to doctors and patients about its potential risks. The medical device maker was ordered to pay $23.5 million in compensatory damages and $50 million in punitive damages. (Salazar v. The Boston Scientific lawsuit had been filed on behalf of a 42-year-old woman who suffered nerve damage, infections and persistent pain after being implanted with the Obtryx product in 2011 to treat stress urinary incontinence. According to a report from Bloomberg News, her attorneys presented jurors with a 2000 email from one Boston Scientific executive who advised sales representatives to ignore a company-funded study that raised questions about the safety of the Obtryx implant.*
