C.R. Bard Transvaginal Mesh Lawsuits Move Forward, With Issuance of New Order in Federal Multidistrict Litigation, Bernstein Liebhard LLP Reports

Transvaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/) filed against C.R. Bard, Inc. continue to move forward in the federal multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to documents filed in the proceeding, the Court issued a Final Order on September 10th that provides for the severance of several actions in the litigation. The Order notes that none of the affected plaintiffs has objected to severance of the cases. (In re C.R. Bard Inc. Pelvic Repair System Products Liability Litigation, MDL No. 2187)

Court documents indicate that C.R. Bard is currently named a defendant in more than 9,000 transvaginal mesh lawsuits that have been filed in the Southern District of West Virginia, where Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee. All of the lawsuits pending in the proceedings allege that the company’s pelvic mesh products used to transvaginally repair pelvic organ prolapse and stress urinary incontinence were defectively designed and manufactured. C.R. Bard is accused of failing to provide adequate warnings regarding the serious risk of vaginal mesh complications associated with the devices.

Mr. Grand is also serving on the Plaintiffs' Steering Committees in a number of other consolidated proceedings underway in the Southern District of West Virginia, including: In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; and In re: Ethicon, Inc. Pelvic Repair Systems Products Liability Litigation - MDL No. 2327.

In addition, Mr. Grand was appointed Co-Liaison Counsel in two multicounty litigations that were established in New Jersey's Atlantic County Superior Court for vaginal mesh lawsuits filed against C.R. Bard and Ethicon. He was also a member of the trial team for the proceedings' first Ethicon mesh trial. That case ended in March 2013, after a woman injured by a Gynecare Prolift device was awarded more than $11 million in damages.
