Thousands of transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) filed against C.R. Bard Inc. continue to move forward in a federal litigation now underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. On January 9th, the Court issued the First Amended Docket Control Order pertaining to the selection and discovery of 200 cases for trial. Among other things, the Order stipulates that those cases which are to be tried in the Southern District of West Virginia will be deemed trial ready by February 2, 2015, or as soon as the Court rules on the parties’ dispositive motions, whichever is later. Trial dates for any vaginal mesh lawsuits transferred or remanded to other federal district courts will be determined by the judge to whom the case is assigned. (In Re: C.R. Transvaginal Mesh Lawsuits
According to court documents, more than 10,000 transvaginal mesh lawsuits are currently pending against C.R. Bard in the Southern District of West Virginia, where Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee. All of the lawsuits were filed on behalf of women who allegedly suffered mesh erosion, pain during sexual intercourse, organ damage and other serious vaginal mesh complications following implantation of the company’s pelvic mesh products.

The first federal trial of a C.R. Bard transvaginal mesh lawsuit concluded in the Southern District of West Virginia in August 2013, with the plaintiff being awarded $2 million for injuries caused by the company’s Avaulta mesh product. (Cisson v. C.R. Bard Inc., 11-cv-00195, U.S. District Court)

Pelvic Repair Systems Products Liability Litigation - MDL No. 2327; and In Re: Neomedic Pelvic Repair System Products Liability Litigation - MDL No. 2511.

In addition to his work on the federal proceeding, Mr. Grand was also appointed Co-Liaison Counsel in two consolidated litigations established for C.R. Bard and Ethicon mesh lawsuits in New Jersey’s Atlantic Superior Court. He was also a member of the trial team on the first Ethicon trial, which ended in March 2013 with an $11 million verdict for the Plaintiff.
