Transvaginal Mesh Lawsuit News: Federal Court Issues New Order in C.R. Bard Pelvic Mesh Litigation, Bernstein Liebhard LLP Reports

Bard, Inc. continues to move forward in the U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to an Order dated January 22nd, the Court has issued directives regarding the filing of responses and replies to certain motions that pertain to those cases selected for Wave I and Wave 2 trials. A previous Order issued by the Court on January 9th indicated that the Wave 1 and 2 case scheduled for trial in the Southern District of West Virginia could be deemed trial ready as early as February 2, 2015. Transvaginal Mesh Lawsuits
According to court documents, more than 10,000 transvaginal mesh lawsuits are currently pending against C.R. Bard in the Southern District of West Virginia. All of the lawsuits were filed on behalf of women who allegedly suffered mesh erosion, pain during sexual intercourse, organ damage and other serious vaginal mesh complications following implantation of the company’s pelvic mesh products. Court records indicate that one federal trial of a C.R. Bard lawsuit involving the Avaulta Plus device concluded in August 2013, with a judgment for the Plaintiff in the amount of $2 million. In addition to his work on the federal proceeding, Mr. Grand was also appointed Co-Liaison Counsel in two consolidated litigations established for C.R. Bard and Ethicon mesh lawsuits in New Jersey’s Atlantic Superior Court. He was also a member of the trial team on the first Ethicon trial, which ended in March 2013 with an $11 million verdict for the Plaintiff.
