Ethicon Transvaginal Mesh Lawsuit News: Bernstein Liebhard LLP Notes Issuance of New Order in Federal Ethicon Mesh Litigation
New York, New York (PRWEB) July 18, 2013 -- Ethicon transvaginal mesh lawsuit claims continue to move forward in a multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to a Pretrial Order dated July 16, 2013, the Court has denied the Defendant’s motion requesting that rule and fact depositions of witnesses be taken in tandem when they involve the same individual. Among other things, the Order points out that the litigation’s deposition protocols anticipates that the parties will schedule depositions in a manner and sequence designed to reduce the burdens on the witnesses and to prevent duplication of testimony.

Ethicon Mesh Lawsuits
Court documents indicate that thousands of women have filed transvaginal mesh lawsuits in the Southern District of West Virginia, including more than 8,400 Ethicon mesh lawsuits. Ethicon, Inc. is also named in more than 3,900 similar claims that have been filed in a consolidated litigation underway in Atlantic County Superior Court in New Jersey. In March, the Plaintiff in the first Ethicon mesh trial in the U.S. was awarded more than $11 million, including $7.76 million in punitive damages, after a New Jersey Superior Court jury found that patients were not properly warned about the risks associated with the Gynecare Prolift device. Mr. Grand, who serves as Co-Liaison Counsel for that litigation, was also a member of the Plaintiff’s trial team for this case. (Gross v. Transvaginal mesh lawsuits have been mounting since October 2008, when the U.S. Food and Drug Administration (FDA) alerted the public that it had received more than 1,000 reports of serious vaginal mesh complications. In July 2011, the FDA issued a second alert after such reports increased by five-fold, with the regulator now warning that the frequency of complications associated with transvaginal prolapse repair was “not rare.”* According to court filings, plaintiffs in vaginal mesh lawsuits have allegedly suffered a number of serious injuries following implantation of the devices to treat pelvic organ prolapse and stress urinary incontinence, including mesh erosion through vaginal tissue, pain, urinary problems and infection
