Transvaginal Mesh Lawsuit News: Bernstein Liebhard LLP Notes New Plaintiff Filing in Federal Ethicon Vaginal Mesh Litigation
New York, New York (PRWEB) December 06, 2013 -- Plaintiffs in transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) filed against Johnson & Johnson and its Ethicon, Inc. unit have charged in a court filing that Ethicon lost or destroyed certain documents relevant to their cases. According to documents filed with the U.S. District Court, Southern District of West Virginia on December 2nd, plaintiffs assert that Ethicon has acknowledged that the documents, which pertain to the development and regulatory approval of its Gynecare pelvic mesh products, were mishandled. The motion seeks to bar the companies from using certain defenses in bellwether trials that are scheduled to get underway next year in the federal proceeding. Court documents indicate that Johnson & Johnson and Ethicon are named in more than 12,000 claims filed in the Southern District of West Virginia on behalf of alleged victims of serious vaginal mesh complications. The companies are also facing more than 4,000 similar transvaginal mesh lawsuits pending in a consolidated proceeding underway in New Jersey’s Atlantic County Superior Court, where the first trial ended in March with an award of $11 million to the Plaintiff.
