Plaintiffs in transvaginal mesh lawsuits (http://www.transvaginalmeshlawsuitclaims.com/ ) filed against Johnson & Johnson and its Ethicon, Inc. unit have charged in a court filing that Ethicon lost or destroyed certain documents relevant to their cases. According to documents filed with the U.S. District Court, Southern District of West Virginia on December 2nd, plaintiffs assert that Ethicon has acknowledged that the documents, which pertain to the development and regulatory approval of its Gynecare pelvic mesh products, were mishandled. The motion seeks to bar the companies from using certain defenses in bellwether trials that are scheduled to get underway next year in the federal proceeding. “Our Firm is representing numerous women in Ethicon vaginal mesh lawsuits that have been filed in this litigation, and we will be monitoring this issue very closely,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. Firm partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee for the federal Ethicon litigation. Bernstein Liebhard LLP continues to evaluate legal claims on behalf of women who suffered serious injuries, allegedly due to products marketed by Ethicon and other manufacturers.
