Johnson & Johnson Seeks Dismissal of 100+ Transvaginal Mesh Lawsuits in Pennsylvania Litigation, Bernstein Liebhard LLP Reports
New York, NY (PRWEB) October 11, 2014 -- Johnson & Johnson, whose Ethicon, Inc. unit is named in thousands of transvaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/) currently pending in U.S. courts, is seeking the dismissal of more than 100 such claims that have been filed in a mass tort proceeding underway in Pennsylvania’s Philadelphia Court of Common Pleas. According to a Motion filed on September 29th, Johnson & Johnson pointed out that the plaintiffs in those claims were residents of 31 different states, and asserted that none had shown any link to Pennsylvania that would justify the Court’s jurisdiction. However, in a Brief filed on October 8th, the plaintiffs asserted that the company was subject to general jurisdiction in the state due to the fact that both Johnson & Johnson and Ethicon conduct business through numerous Pennsylvania subsidiaries and employ thousands of Pennsylvania citizens. More than 20,000 of these cases have been consolidated in a multidistrict litigation currently underway in the U.S. District Court, Southern District of West Virginia, where Bernstein Liebhard LLP partner, Jeffrey S. The litigation concluded its first trial in September, when the jury hearing the case awarded $3.27 million to a woman who suffered complications related to Ethicon’s Gynecare TVT O-Mesh device. In addition to his work on the federal Ethicon litigations, Mr. Grand is serving as Co-Liaison Counsel in a Multicounty Litigation underway in New Jersey’s Atlantic Superior Court involving Ethicon mesh products. He was also a member of the Plaintiff’s trial team for its first bellwether trial, which ended in March 2013 with the jury awarding more than $11 million in compensatory and punitive damages to a woman injured by the Gynecare Prolift device.
