Transvaginal mesh lawsuits (http://www.filevaginalmeshlawsuit.com/) filed against Johnson & Johnson’s Ethicon, Inc. unit continue to move forward in state and federal courts around the country, Bernstein Liebhard LLP reports. According to court documents, a trial involving Ethicon’s TVT-Abbrevo pelvic mesh sling opened on January 26th in the Superior Court of California, Kern County. The Plaintiff in the case, a woman who received the TVT-Abbrevo sling in 2011 to treat stress urinary incontinence, claims that the device has caused her continuing pain and urinary problems, even after she underwent surgery to remove the mesh. During Monday’s Opening Statements, her attorney told the assembled jury that the Plaintiff would present evidence showing that the “product was not reliably tested before it was sold and, in fact, her doctor wasn’t told the full truth about the dangers of the product.” (Perry v. Transvaginal Mesh Litigation
According to court documents, more than 20,000 claims have been filed in U.S. courts on behalf of women who were allegedly harmed by Ethicon’s transvaginal mesh products used to treat pelvic organ prolapse and stress urinary incontinence. The majority of these lawsuits are pending in a federal multidistrict litigation underway in U.S. District Court, Southern District of West Virginia, where Jeffrey S. In September 2014, the jury hearing arguments in the federal litigation’s second bellwether case awarded $3.27 million to a woman who suffered serious vaginal mesh complications due to the erosion of the Ethicon TVT-O Mesh sling. (Huskey v. Ethicon, Inc. et al, Case No. No. 2:2012cv05201) The proceeding’s third bellwether trial is expected to begin in March.
In addition to his work on the federal Ethicon litigation, Mr. Grand is serving as Co-Liaison Counsel in a Multicounty Litigation underway in New Jersey Superior Court involving Ethicon mesh products. He was also a member of the Plaintiff’s trial team for its first bellwether trial, which ended in March 2013 with the jury awarding more than $11 million in compensatory and punitive damages to a woman injured by the Gynecare Prolift device. Court records indicate that more than 67,000 transvaginal mesh lawsuits are currently pending in several litigations underway in the Southern District of West Virginia.
