Ethicon, Inc., a defendant in thousands of transvaginal mesh lawsuits (http://www.drugbot.com/transvaginal-mesh/lawsuit/), wants a federal judge to reverse the $3.27 million awarded to a plaintiff in one of those cases last month, Bernstein Liebhard LLP reports. According to court documents, during arguments presented on October 15, 2014, in the U.S. District Court, Southern District of West Virginia, Ethicon asserted that the plaintiff had not offered enough evidence to support the allegations put forth in her complaint. The company asked the Court to toss the verdict and grant it either a judgment as a matter of law or a new trial. (Huskey v. Ethicon, Case No. 12-5201)

Vaginal Mesh Litigation
According to court documents, Ethicon is named a defendant in more than 30,000 transvaginal mesh lawsuits pending in courts nationwide, including more than 21,000 that have been filed in the Southern District of West Virginia. Last month, the jury hearing arguments in the litigation’s second bellwether case awarded $3.27 million to a woman who suffered serious vaginal mesh complications due to the erosion of the TVT-O Mesh sling. After two weeks of testimony, the jury found Ethicon liable for selling a defective product, and for failing to warn patients and doctors about the risks associated with the device.
Court records indicate that more than 60,000 transvaginal mesh lawsuits are currently pending in several litigations underway in the Southern District of West Virginia. Mr. Grand is also a member of the Plaintiff’s Steering Committee in several other vaginal mesh proceedings underway in U.S. District Court, Southern District of West Virginia, including those involving American Medical Systems, Inc. (MDL No. 2325), Boston Scientific Corp. (MDL No. 2326), C.R. Bard, Inc. (MDL No. 2187) and Ethicon, Inc. (MDL No. 2327).
In addition to his work on the federal Ethicon litigation, Mr. Grand is serving as Co-Liaison Counsel in a Multicounty Litigation underway in New Jersey’s Atlantic Superior Court involving Ethicon mesh products. He was also a member of the Plaintiff’s trial team for its first bellwether trial, which ended in March 2013 with the jury awarding more than $11 million in compensatory and punitive damages to a woman injured by the Gynecare Prolift device.
