Over 10,000 Transvaginal Mesh Lawsuit Claims Now Pending in Federal American Medical Systems Litigation, Bernstein Liebhard LLP Reports

According to a recent update posted on the court’s website, a total of 10,633 cases had been filed in the proceeding as of October 8th. Less than two weeks earlier, the federal judge overseeing the litigation scheduled a hearing on certain Motions for October 10th, with a status conference to follow on November 7th, 2013. These motions pertain to federally-filed vaginal mesh lawsuits brought by women who claim to have suffered horrific injuries allegedly caused by pelvic mesh implants marketed by American Medical Systems.

In New Jersey’s Atlantic County Superior Court, Mr. Grand has been named Co-Liaison Counsel in two consolidated proceedings established for C.R. Bard and Ethicon transvaginal mesh lawsuits. He also served on the plaintiff’s trial team on the first Ethicon trial in the New Jersey litigation, which concluded in March 2013 with an $11 million damage award to the Plaintiff. Vaginal mesh lawsuits have been on the rise since October 2008, when a public health alert issued by the U.S. Food and Drug Administration (FDA) warned that approximately 1,000 adverse event reports associated with transvaginal mesh had been filed with the agency over a period of three years. At the time, the frequency of these injuries to occur was classified as ‘rare.’ After learning that the number of complaints had grown five-fold since 2008, however, the FDA re-categorized the potential as ‘not rare’ in 2011. Mesh erosion, chronic infection, organ damage and shrinkage are currently among the most common pelvic mesh injuries reported to the FDA.
