New York, NY (PRWEB) October 13, 2013
The number of transvaginal mesh lawsuit (http://www.transvaginalmeshlawsuithelp.com/) claims alleging mesh erosion, vaginal scarring and other injuries stemming from devices manufactured by American Medical Systems, Inc. has officially surpassed 10,000 in a federal litigation underway in the U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports.
According to a recent update posted on the court’s website, a total of 10,633 cases had been filed in the proceeding as of October 8th. Less than two weeks earlier, the federal judge overseeing the litigation scheduled a hearing on certain Motions for October 10th, with a status conference to follow on November 7th, 2013. These motions pertain to federally-filed vaginal mesh lawsuits brought by women who claim to have suffered horrific injuries allegedly caused by pelvic mesh implants marketed by American Medical Systems.
“We are not surprised to see the number of lawsuits filed in the federal American Medical Systems litigation exceed 10,000, given that our Firm hears from women who allegedly suffered the traumatizing side effects of transvaginal mesh on a regular basis. We are pleased to see this proceeding moving forward at a swift pace,” says Bernstein Liebhard LLP, a nationwide law firm representing individuals harmed by defective drugs and medical devices. The Firm is currently offering free and confidential case evaluations to potential transvaginal mesh lawsuit claimants who may have sustained mesh erosion, painful sexual intercourse, chronic pain and other injuries. Jeffrey S. Grand, a partner at Bernstein Liebhard LLP is also actively involved in the federal American Medical Systems litigation as a member of its Plaintiffs’ Steering Committee.
Transvaginal Mesh Lawsuits
In addition to the thousands of transvaginal mesh lawsuits currently pending in the federal American Medical Systems litigation, court documents show that a total of 30,000 claims have been filed in separate federal proceedings involving sixvaginal mesh manufacturers in the U.S. District Court, Southern District of West Virginia. Mr. Grand is serving on the Plaintiffs’ Steering Committee for the following four litigations: In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326); In re: Ethicon, Inc. (MDL No. 2327) and In re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”).
In New Jersey’s Atlantic County Superior Court, Mr. Grand has been named Co-Liaison Counsel in two consolidated proceedings established for C.R. Bard and Ethicon transvaginal mesh lawsuits. He also served on the plaintiff’s trial team on the first Ethicon trial in the New Jersey litigation, which concluded in March 2013 with an $11 million damage award to the Plaintiff. Vaginal mesh lawsuits have been on the rise since October 2008, when a public health alert issued by the U.S. Food and Drug Administration (FDA) warned that approximately 1,000 adverse event reports associated with transvaginal mesh had been filed with the agency over a period of three years. At the time, the frequency of these injuries to occur was classified as ‘rare.’ After learning that the number of complaints had grown five-fold since 2008, however, the FDA re-categorized the potential as ‘not rare’ in 2011. Mesh erosion, chronic infection, organ damage and shrinkage are currently among the most common pelvic mesh injuries reported to the FDA.
If you sustained serious vaginal mesh complications after undergoing surgery to repair pelvic organ prolapse or stress urinary incontinence, you may be eligible to file a lawsuit seeking compensation for damages incurred by your injuries.
