The second federal bellwether CR Bard transvaginal mesh trial ended after two days in a settlement between plaintiff Wanda Queen and the mesh maker for an undisclosed sum, according to an Aug. 21 Bloomberg story. Queen had claimed that her Bard Avaulta vaginal mesh caused her pain and forced her to have six surgeries, according to Bloomberg’s reporting on the lawsuit (Queen et al v. C. R. Bard, Inc.; 2:11-cv-00012, MDL-2187, U.S. District Court for the Southern District of West Virginia). This comes on the heels of a $2 million verdict against Bard last week. Bard faces more than 8,000 claims against it over the Avaulta, the article said.
“It would seem that the three verdicts for plaintiffs handed down in state and federal courts have sent a message to Bard: that it will be held accountable for the harms caused by its products,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “It's not surprising, then, that Bard will try to settle cases now, if it can offer an acceptable amount to each plaintiff and avoid the costs of going to trial, expecting that each plaintiff is more likely than not to prevail. And settlements will allow Bard to avoid further punitive damages assessments, which can very quickly add up to a lot of money.”
Several mesh manufacturers are also defendants in several thousands of federal lawsuits consolidated for pretrial efficiency.** Another recent vaginal mesh award involving Bard included a 2012 verdict in California that resulted in a $5.5 million damages award*** to the plaintiff.
