The Orders, which are dated November 5th and 6th respectively, pertain to procedures for filing certain individual transvaginal mesh lawsuits in the multidistrict litigations. According to court documents, more than 30,000 transvaginal mesh lawsuits are now pending in several multidistrict litigations underway in the Southern District of West Virginia. This includes more than 11,500 claims filed against American Medical Systems, and more than 11,400 involving Ethicon. All of the lawsuits pending in the proceedings allege that the companies’ pelvic mesh products used to transvaginally repair pelvic organ prolapse and stress urinary incontinence were defectively designed and manufactured. Defendants are accused of failing to provide adequate warnings regarding the serious risk of vaginal mesh complications associated with the devices.

In addition to his work on the federal litigations for American Medical Systems and Ethicon, Bernstein Liebhard LLP partner, Jeffrey S. Grand, is also a member of the Plaintiffs’ Steering Committees for proceedings underway in the Southern District of West Virginia for transvaginal mesh lawsuits filed against Boston Scientific Corp., (MDL No. 2326) and C.R. Bard, Inc., (MDL No. 2187).

Mr. Grand is also serving as Co-Liaison Counsel in two consolidated litigations established in New Jersey’s Atlantic County Superior Court for claims involving pelvic mesh manufactured by C.R. Bard and Ethicon. He was also a member of the trial team on the first Ethicon trial in that proceeding, which ended in March with an $11 million verdict for the Plaintiff who suffered serious vaginal mesh complications due to the Gynecare Prolift device.
