Federal Transvaginal Mesh Lawsuits Pass 40,000 Filings, as Bernstein Liebhard LLP Notes Order Expanding Plaintiffs’ Executive Committee
New York, New York (PRWEB) December 11, 2013 -- More than 40,000 transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) are now pending in six multidistrict litigations currently underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to pretrial orders issued on December 6th, the mounting number of claims has prompted the Court to appoint additional attorneys to the Plaintiffs’ Executive Committee for the proceedings. The orders apply to all of the multidistrict litigations established for vaginal mesh lawsuits in the Southern District of West Virginia, including those involving American Medical Systems, Inc. (MDL No. 2325), Boston Scientific Corp. (MDL No. 2326), C.R. Bard, Inc. (MDL No. 2187) and Ethicon, Inc. (MDL No. 2327)

According to court documents, the litigations’ first bellwether trial, involving a C.R. Bard Avaulta mesh product, concluded in August with a judgment of $2 million in favor of the plaintiff. (Cisson v. C.R. Bard Inc., 11-cv-00195) A second C.R. Bard trial will get underway in the litigation in January.
In addition to his work with the federal litigations, Mr. Grand is also serving as Co-Liaison Counsel in two multicounty litigations involving vaginal mesh lawsuits filed against C.R. Bard and Ethicon that are currently moving forward in New Jersey’s Atlantic County Superior Court. He was also a member of the trial team on the first Ethicon trial in that proceeding, which ended in March with an $11 million verdict for the Plaintiff.
