Plaintiffs in C.R. Bard Litigation Ask Federal Judge to Have Transvaginal Mesh Lawsuits Combined for Trial, Bernstein Liebhard LLP Reports

Bard Inc. are continuing to move forward in the U.S. District Court, Southern District of West Virginia, where a request was recently filed by plaintiffs in the litigation, Bernstein Liebhard LLP reports.
According to a report on November 25th from MassDevice.com, plaintiffs in 185 cases involving the pelvic mesh manufacturer’s products asked the federal judge overseeing the proceeding to consolidate these cases for trials, citing the similarity of claims included in each lawsuit.* Transvaginal mesh lawsuits filed in the C.R. Bard litigation allege similarly serious complications caused by the company’s devices, which are used in the treatment of stress urinary incontinence and pelvic organ prolapse. (In Re: C.R. According to court documents updated in the Southern District of West Virginia, at least 10,000 transvaginal mesh lawsuits have now been filed in the federal C.R. Women whose cases are filed in the proceeding similarly allege mesh erosion, scarring, organ damage and infection caused by implants manufactured by C.R. Bard, who they accuse of failing to warn about the potential for these and other serious vaginal mesh complications to occur.
Court records show more than 60,000 transvaginal mesh lawsuits have been filed in several litigations now underway in the U.S. District Court, Southern District of West Virginia. Aside from his involvement in the C.R. Mr. Grand is also playing an active role in the consolidated C.R. Bard vaginal mesh litigation now pending in New Jersey, where a number of state-filed lawsuits have been centralized. He was appointed Co-Liaison Counsel in this proceeding, as well as another involving implants manufactured by Johnson & Johnson’s Ethicon unit. He served as member of the plaintiff’s trial team for New Jersey’s first Ethicon trial, which ended in March 2013 with an $11 million damage award for a woman whose injuries were found to be a result of the Gynecare Prolift device.
