Transvaginal Mesh Lawsuit News: New Order in American Medical Systems Litigation Addresses Federal Bellwether Trials, Bernstein Liebhard LLP Reports
New York, NY (PRWEB) October 15, 2013 -- Federal bellwether trials involving transvaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/) filed against American Medical Systems, Inc., are scheduled to begin next April in the multidistrict litigation underway in the in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to an Order issued on October 10th, the Court has directed the parties to submit a list that ranks the vaginal mesh lawsuits designated as potential bellwether cases in preferred order for trial no later than December 6, 2013. The Court will then select cases for the first two rounds of bellwether trials as soon as is practical. American Medical Systems and other pelvic mesh manufacturers have been facing a mounting number of vaginal mesh lawsuits since October 2008, when the U.S. Food & Drug Administration (FDA) issued its first of two alerts to warn the public of the serious risks associated with the use of transvaginal mesh to treat pelvic organ prolapse and stress urinary incontinence. The FDA’s second alert, which was issued in July 2011, revealed that the agency no longer considered vaginal mesh complications associated with prolapse repair to be a rare occurrence.
