Transvaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/) involving Ethicon Inc.’s Gynecare pelvic mesh products continue to move forward in a multidistrict litigation underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to court documents, a new Pretrial Order was issued on October 10th, finalizing the procedures for filing certain individual transvaginal mesh lawsuits in the multidistrict litigation. Vaginal Mesh Lawsuits
Court records indicate that the number of transvaginal mesh lawsuits filed against Ethicon in the Southern District of West Virginia has now surpassed 10,500. All of the claims allege the company’s Gynecare pelvic mesh products were defectively designed, and caused women to suffer serious complications, including mesh erosion, chronic pain, infection, and organ damage. The lawsuits further allege that Ethicon failed to provide patients or doctors with adequate warnings regarding the serious risk of transvaginal mesh complications.
According to court documents, the Ethicon litigation is just one of six proceedings underway in the Southern District of West Virginia, where more than 30,000 vaginal mesh lawsuits are now pending. Bernstein Liebhard LLP partner, Jeffrey S. Grand, has also been named to the Plaintiffs’ Steering Committees for proceedings involving American Medical Systems, Inc. (MDL No. 2325);Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187).
Court records show that Ethicon is also facing more than 4,400 transvaginal mesh lawsuits in a New Jersey Multicounty Litigation underway in Atlantic County Superior Court, where Mr. Grand is serving as Co-Liaison Counsel. He was also a member of the Plaintiffs’ trial team for the proceedings’ first trial of an Ethicon vaginal mesh lawsuit, which ended in March with an $11 million award to the Plaintiff.
