Vaginal Mesh Lawsuits Move Forward, as Bernstein Liebhard LLP Notes Issuance of New Order in Federal Transvaginal Mesh Litigations
New York, New York (PRWEB) December 26, 2013 -- Tens of thousands of transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) continue to move forward in multidistrict litigations now underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to court documents dated December 20th, the judge presiding over the litigations has granted the parties’ Joint Motion seeking an Order to Show Cause as to why the Court should not dismiss without prejudice certain defendants from all cases. The Court has further stipulated that any plaintiff opposed to entry of the Order must file their objections by January 6, 2014. A hearing on the matter has been scheduled for January 9th. The directive applies to all transvaginal mesh lawsuits currently pending in the Southern District of West Virginia, including those filed against American Medical Systems, Inc. (MDL No. 2325), Boston Scientific Corp. (MDL No. 2326), C.R. Bard, Inc. (MDL No. 2187) and Ethicon, Inc. (MDL No. 2327).

All of transvaginal mesh lawsuits filed in these litigations similarly allege that patients and doctors were not provided with adequate warnings about the serious risks associated with pelvic mesh devices used to treat pelvic organ prolapse and stress urinary incontinence. According to court records, the litigations’ first bellwether trial, involving a C.R. Bard Avaulta mesh product, concluded in August with a judgment of $2 million in favor of the plaintiff. (Cisson v. C.R. Bard Inc., 11-cv-00195) A second C.R. Bard trial will get underway in West Virginia on January 10th.
In addition to his work on federal vaginal mesh lawsuits, Mr. Grand is also serving as Co-Liaison Counsel in two multicounty litigations for state claims filed against C.R. Bard and Ethicon that are currently moving forward in New Jersey’s Atlantic County Superior Court. He was also a member of the trial team on the first Ethicon trial in that proceeding, which ended in March with an $11 million verdict for the Plaintiff.
