Transvaginal Mesh Lawsuits Move Forward, as Bernstein Liebhard LLP Notes Issuance of New Order in Federal C.R. Bard Litigation

Bard, Inc. continues to move forward in the U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. On January 9, 2014, the Court issued a Stipulated Protective Order pertaining to non-party documents produced in accordance with certain subpoenas issued by C.R. Bard. (In re C.R. Bard Inc. Vaginal Mesh Lawsuits
According to court documents, more than 6,300 vaginal mesh lawsuits have been filed against C.R. Bard in the Southern District of West Virginia. The proceeding’s first bellwether trial concluded in August, with the jury awarding $2 million in compensatory and punitive damages to the Plaintiff. Court records further indicate that what was to have been the litigation’s second bellwether trial settled on the day the trial was set to begin, while the third case set for a bellwether trial was voluntarily dismissed by the Plaintiff. The fourth transvaginal mesh lawsuit selected for a bellwether trial was supposed to go before a jury on January 10, 2014, but court documents filed in the case indicate that it has been postponed indefinitely.
C.R. Bard is just one of several manufacturers named in claims that are pending in the Southern District of West Virginia. Bernstein Liebhard LLP partner, Jeffrey S.
