Thousands of transvaginal mesh lawsuits ( filed against American Medical Systems, Inc. continue to move forward in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to an Order dated February 4, 2014, the Court has granted Plaintiffs’ Motion to Compel the production of a corporate designee for deposition regarding certain matters relating to the Elevate pelvic mesh device. Among other things, the Order directs American Medical Systems to produce a corporate designee by February 13, 2014, and stipulates that Plaintiffs must take steps to avoid asking duplicative questions of the designee. Vaginal Mesh Lawsuits
Court documents indicate that more than 15,500 vaginal mesh lawsuits that have been filed in the Southern District of West Virginia against American Medical Systems. The claims involve similar allegations regarding the design and manufacture of the company’s transvaginal mesh products, and their propensity to cause serious and life-changing vaginal mesh complications. According to court records, the first federal trials involving an American Medical Systems vaginal mesh lawsuit will begin in April.

According to court documents, more than 40,000 claims are pending in Southern District of West Virginia against the manufacturers of transvaginal mesh devices used in pelvic organ prolapse and stress urinary incontinence. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is also serving on the Plaintiffs’ Steering Committees for federal proceedings involving Boston Scientific Corp., (MDL No. 2326); C.R. Bard, Inc., (MDL No. 2187), and In re: Ethicon, Inc. (MDL No. 2327).

Mr. Grand has also been appointed Co-Liaison Counsel in two multicounty litigations underway in New Jersey Superior Court for transvaginal mesh lawsuits involving products marketed by C.R. Bard and Ethicon. He was also a member of the Plaintiff’s trial team on the first Ethicon trial in that proceeding, which ended in March with a jury awarding $11 million in compensatory and punitive damages to a woman who was harmed by the Ethicon Gynecare Prolift device.
