Bellwether trials may provide valuable insight into how juries will rule in similar vaginal mesh lawsuits.

New York, New York (PRWEB) March 17, 2014

Thousands of transvaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/ ) filed against Johnson & Johnson and its Ethicon, Inc. unit continue to move forward in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to a Second Amended Docket Control Order issued on March 14, 2014, the Court has established new deadlines governing discovery, motions practice, and other matters pertaining to the proceeding’s second round of bellwether trials. The Ethicon litigation’s second bellwether trial is scheduled to begin on June 23, 2014. (In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2327)

“We are representing hundreds of women who allegedly suffered serious vaginal mesh complications due to products marketed by Ethicon and other companies. Bellwether trials may provide valuable insight into how juries will rule in similar vaginal mesh lawsuits,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm is currently offering free legal evaluations to women who allegedly suffered mesh erosion, pain, scarring, infection and other serious injuries following the implantation of surgical mesh to treat pelvic organ prolapse or stress urinary incontinence.

Transvaginal Mesh Lawsuits
Court documents indicate that nearly 17,000 transvaginal mesh lawsuits have been filed in the Southern District of West Virginia against Ethicon and Johnson & Johnson. All of these complaints similarly allege that Ethicon’s pelvic mesh products used in the treatment of pelvic organ prolapse and stress urinary incontinence were defectively designed and manufactured. The lawsuits further accuse the defendants of failing to warn doctors and patients of their association with mesh erosion, chronic pain, organ damage and other serious vaginal mesh complications allegedly suffered by women with claims pending in the proceeding.

Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs' Steering Committee in the federal Ethicon litigation.

Ethicon and Johnson & Johnson have also been named defendants in at least 4,762 vaginal mesh lawsuits that have been filed in a multicounty litigation now underway in New Jersey’s Atlantic County Superior Court. Mr. Grand has also been named Co-Liaison Counsel in that proceeding, and served on the Plaintiff's team in its first trial involving an Ethicon lawsuit. That case concluded last March, when the Plaintiff was awarded more than $11 million for injuries she suffered from Prolift mesh. (In re: Pelvic Mesh/Gynecare Litigation, No. 6341-10)

The federal Ethicon vaginal mesh litigation is one of several currently underway in the Southern District of West Virginia. Mr. Grand is also serving on the Plaintiffs' Steering Committees for three other federal vaginal mesh proceedings, including: American Medical Systems, Inc. (MDL No. 2325); Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187). He was also named Co-Liaison Counsel in a second litigation underway in Atlantic County Superior Court for lawsuits involving C.R. Bard products. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10)

Women who suffered serious vaginal mesh complications allegedly due to products manufactured by Ethicon or another company could be entitled to compensation.
