Transvaginal Mesh Lawsuits Move Forward in Federal Litigation, as Bernstein Liebhard LLP Notes Scheduling of Bellwether Trial

Bard Inc. continue to move forward in a multidistrict litigation underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to court documents, the proceeding’s next bellwether trial is now scheduled to begin on May 19, 2014. The case selected for this the upcoming trial was filed on behalf of a woman who allegedly suffered serious vaginal mesh complications following implantation of an Avaulta mesh device. (In re C.R. In 2012, a vaginal mesh lawsuit involving a C.R. Bard Avaulta device concluded in California Superior Court when C.R. Bard was ordered to pay a $3.6 million portion of a $5.5 million judgment awarded to the Plaintiff. The woman’s physician was ordered to pay the remaining portion of the judgment. (Scott v. According to court documents, at least 40,000 transvaginal mesh lawsuits have been filed in the Southern District of West Virginia against a number of pelvic mesh manufacturers.
