New York, NY (PRWEB) April 14, 2014
The federal judge overseeing thousands of transvaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/) filed against Boston Scientific Corp. in the U.S. District Court, Southern District of West Virginia has consolidated five individual claims for discovery and trial on all issues. According to an Order dated April 11th, the five complaints were all filed by plaintiffs who reside in the state of Florida who were allegedly injured by Boston Scientific’s Pinnacle Pelvic Floor Kit, a device used to treat pelvic organ prolapse. At the conclusion of pretrial proceedings, the consolidated lawsuits will be transferred to U.S. District Court, Southern District of Florida, where U.S. District Judge Joseph R. Goodwin will try the cases by intercircuit assignment beginning on September 29, 2014. (Case No. 2:13-cv-07965)

Transvaginal Mesh Lawsuits
Court records indicate that Boston Scientific is named in more than 11,000 vaginal mesh lawsuits involving the Pinnacle Pelvic Floor Kit and other mesh implants used to treat prolapse and stress urinary incontinence. Among other things, the lawsuits claim that these devices were defectively designed and manufactured, and caused recipients to suffer a range of painful and debilitating complications, including mesh erosion, organ damage, infections, and bleeding. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee for the proceeding. (In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326)
Mr. Grand is also serving on the Plaintiffs’ Steering Committees in several other multidistrict litigations established for transvaginal mesh lawsuits in the Southern District of West Virginia. These include proceedings involving American Medical Systems, Inc. (MDL No. 2325), C.R. Bard, Inc. (MDL 2326) and Ethicon, Inc. (MDL No. 2327).
Mr. Grand was also appointed Co-Liaison Counsel in two consolidated proceedings established for C.R. Bard and Ethicon mesh lawsuits in New Jersey’s Atlantic Superior Court. He was also a member of the trial team on the first Ethicon trial, which ended in March with an $11 million verdict for the Plaintiff.
