Ethicon Vaginal Mesh Lawsuits Move Forward, With Issuance of New Order Pertaining to Upcoming Federal Trial, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) October 20, 2014 -- Thousands of vaginal mesh lawsuits (http://www.consumerinjurylawyers.com/gynecare/) filed against Ethicon, Inc. continue to move forward in a federal multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to an Amended Docket Control Order issued on October 15, 2014, the Court will conduct a Pretrial Conference on November 24, 2014 for the proceeding’s third bellwether trial. Ethicon Mesh Litigation
Court records indicate that more than 21,000 claims have been filed in the Southern District of West Virginia on behalf of women who were allegedly injured by Ethicon’s transvaginal mesh devices. All of the claims similarly allege that these products were defectively designed and manufactured, and that Ethicon failed to provide adequate warnings regarding their association with organ damage, mesh erosion, infection, and other serious vaginal mesh complications. Last month, the jury hearing arguments in the litigation’s second bellwether case awarded $3.27 million to a woman who suffered serious vaginal mesh complications due to the erosion of the TVT-O Mesh sling. After two weeks of testimony, the jury found Ethicon liable for selling a defective product, and for failing to warn patients and doctors about the risks associated with the device. (Huskey v. In addition to his work on the federal Ethicon litigation, Mr. Grand is serving as Co-Liaison Counsel in a Multicounty Litigation underway in New Jersey’s Atlantic Superior Court involving Ethicon mesh products. He was also a member of the Plaintiff’s trial team for its first bellwether trial, which ended in March 2013 with the jury awarding more than $11 million in compensatory and punitive damages to a woman injured by the Gynecare Prolift device. Court records indicate that more than 60,000 transvaginal mesh lawsuits are currently pending in several litigations underway in the Southern District of West Virginia. Mr. Grand is also a member of the Plaintiff’s Steering Committee in several other vaginal mesh proceedings underway in U.S. District Court, Southern District of West Virginia, including those involving American Medical Systems, Inc. (MDL No. 2325), Boston Scientific Corp. (MDL No. 2326), C.R. Bard, Inc. (MDL No. 2187) and Ethicon, Inc. (MDL No. 2327).
