Thousands of vaginal mesh lawsuits ( filed against Ethicon, Inc. continue to move forward in a federal multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. “We are representing numerous women who have transvaginal mesh lawsuits pending in the federal Ethicon litigation, and are monitoring developments closely. The outcomes of bellwether trials often provide insight into how juries will rule in similar lawsuits,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm continues to investigate legal claims on behalf of women who suffered serious vaginal mesh complications, allegedly due to products marketed by Ethicon and other manufacturers.

Ethicon Mesh Litigation
Court records indicate that more than 21,000 claims have been filed in the Southern District of West Virginia on behalf of women who were allegedly injured by Ethicon’s transvaginal mesh devices. All of the claims similarly allege that these products were defectively designed and manufactured, and that Ethicon failed to provide adequate warnings regarding their association with organ damage, mesh erosion, infection, and other serious vaginal mesh complications. Jeffrey S. Grand, a partner with Bernstein Liebhard LLP, is serving on the Plaintiffs' Steering Committee for the federal Ethicon proceeding. Last month, the jury hearing arguments in the litigation’s second bellwether case awarded $3.27 million to a woman who suffered serious vaginal mesh complications due to the erosion of the TVT-O Mesh sling. After two weeks of testimony, the jury found Ethicon liable for selling a defective product, and for failing to warn patients and doctors about the risks associated with the device. (Huskey v. Ethicon, Case No. 12-5201)

In addition to his work on the federal Ethicon litigation, Mr. Grand is serving as Co-Liaison Counsel in a Multicounty Litigation underway in New Jersey’s Atlantic Superior Court involving Ethicon mesh products. He was also a member of the Plaintiff’s trial team for its first bellwether trial, which ended in March 2013 with the jury awarding more than $11 million in compensatory and punitive damages to a woman injured by the Gynecare Prolift device. (In re: Pelvic Mesh/Gynecare Litigation, No. 6341-10)

Court records indicate that more than 60,000 transvaginal mesh lawsuits are currently pending in several litigations underway in the Southern District of West Virginia.
