Federal Court Overseeing Thousands of Transvaginal Mesh Lawsuits Set to Convene Joint Status Conference for All Litigations, Bernstein Liebhard LLP Reports

Thousands of transvaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/ ) continue to move forward in a number of multidistrict litigations currently underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to an Order issued on December 2, 2014, the Court is scheduled to convene a Joint Status Conference in all of the proceedings on January 29, 2015, at 10:00 a.m. Parties have been directed to submit a proposed agenda to the Court by noon on January 26, 2015.

Transvaginal Mesh Litigation

Court documents indicate that more than 67,000 claims have been filed in the seven vaginal mesh litigations currently underway in the Southern District of West Virginia. These proceedings include: In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In Re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; In Re: Coloplast Corp. Pelvic Support Systems Products Liability Litigation - MDL No. 2387; In Re: Cook Medical, Inc., Pelvic Repair System Products Liability Litigation - MDL No. 2440; In Re: C.R. Bard, Inc., Pelvic Repair System Products Liability Litigation - MDL No. 2187; In re: Ethicon, Inc. Pelvic Repair Systems Products Liability Litigation - MDL No. 2327; and In Re: Neomedic Pelvic Repair System Products Liability Litigation - MDL No. 2511. Jeffrey S. Grand, a partner at Bernstein Liebhard LLP, is an active member of the Plaintiffs’ Steering Committee in all of these litigations.

All of the lawsuits pending in these proceedings similarly allege that the defendants’ surgical mesh products designed to treat pelvic organ prolapse and stress urinary incontinence caused women to suffer mesh erosion, infection, chronic pain, pain during sexual intercourse and other serious vaginal mesh complications . Plaintiffs in these cases further claim that the device manufacturers failed to provide adequate warnings about their products’ risk, and that the implants were not subjected to sufficient pre-market testing to ensure their safety and effectiveness.

In addition to his work with the federal transvaginal mesh proceedings, Mr. Grand is also serving as Co-Liaison Counsel in two consolidated litigations established in New Jersey’s Bergen County Superior Court. These proceedings include claims from women who were allegedly harmed by pelvic implants manufactured by C.R. Bard and Ethicon.
