Tens of thousands of transvaginal mesh lawsuit (http://www.transvaginalmeshlawsuithelp.com/) filings are continuing to move forward in multidistrict litigations underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to court records, Orders were issued in several of the vaginal mesh litigations that amend requirements to the Delayed Filing Agreement previously reached between the parties. The Orders were issued in proceedings established for vaginal mesh lawsuits involving American Medical Systems, Inc. (MDL No. 2325), Boston Scientific Corp., (MDL No. 2326); and Ethicon, Inc. (MDL No. 2327).
“More than two years after U.S. health regulators issued their last public health alert involving vaginal mesh complications, our Firm continues to hear from women who were allegedly harmed by these devices. We are pleased to see these proceedings moving forward,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm is currently representing hundreds of women in transvaginal mesh lawsuits who allegedly suffered mesh erosion, pain, scarring, infection and other serious injuries following treatment with pelvic mesh devices. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committees in the multidistrict litigations involving American Medical Systems, Boston Scientific and Ethicon. He is also a member of the Committee for the multidistrict litigation underway in the same jurisdiction for vaginal mesh lawsuits involving C.R. Bard’s Avaulta mesh products (MDL No. 2187)
Vaginal Mesh Complications
The current transvaginal mesh litigation got underway shortly after the U.S. Food & Drug Administration (FDA) issued a Public Health Alert revealing that it had received 1,000 reports of serious injuries associated with vaginal mesh products over a three year period. In July 2011, the FDA warned that the number of complication reports associated with transvaginal prolapse repair had grown significantly, a development that prompted the agency to modify its previous stance that such injuries were rare. Court documents now indicate that at least 30,000 vaginal mesh lawsuits have been filed in the Southern District of West Virginia on behalf of women who experienced chronic infections, organ damage, mesh erosion and shrinkage, and other debilitating complications, allegedly due to transvaginal mesh.
In addition to his work on federally-filed transvaginal mesh lawsuits, Bernstein Liebhard LLP partner, Jeffrey S. Grand, has been named Co-Liaison Counsel in two consolidated litigations established for claims filed against C.R. Bard and Ethicon that are currently underway in New Jersey’s Atlantic County Superior Court. He was also a member of the trial team on the first Ethicon trial in that proceeding, which ended in March with an $11 million verdict for the Plaintiff.
