Transvaginal Mesh Lawsuit News: Bernstein Liebhard LLP Notes New Orders in Three Federal Vaginal Mesh Litigations

According to court records, Orders were issued in several of the vaginal mesh litigations that amend requirements to the Delayed Filing Agreement previously reached between the parties. The Orders were issued in proceedings established for vaginal mesh lawsuits involving American Medical Systems, Inc. (MDL No. 2325), Boston Scientific Corp., (MDL No. 2326); and Ethicon, Inc. (MDL No. 2327).

Vaginal Mesh Complications
The current transvaginal mesh litigation got underway shortly after the U.S. Food & Drug Administration (FDA) issued a Public Health Alert revealing that it had received 1,000 reports of serious injuries associated with vaginal mesh products over a three year period. In July 2011, the FDA warned that the number of complication reports associated with transvaginal prolapse repair had grown significantly, a development that prompted the agency to modify its previous stance that such injuries were rare. Court documents now indicate that at least 30,000 vaginal mesh lawsuits have been filed in the Southern District of West Virginia on behalf of women who experienced chronic infections, organ damage, mesh erosion and shrinkage, and other debilitating complications, allegedly due to transvaginal mesh.
In addition to his work on federally-filed transvaginal mesh lawsuits, Bernstein Liebhard LLP partner, Jeffrey S. Grand, has been named Co-Liaison Counsel in two consolidated litigations established for claims filed against C.R. Bard and Ethicon that are currently underway in New Jersey’s Atlantic County Superior Court.
