Ethicon transvaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/) continue to move forward in a multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to the litigation’s First Amended Docket Control Order dated October 10, 2013, a number of deadlines have been established that pertain to the proceeding’s second round of bellwether trials. Transvaginal Mesh Lawsuits
According to court documents, more than 10,000 Ethicon vaginal mesh lawsuits have been filed in the Southern District of West Virginia, all of which allege the company’s Gynecare products were defectively designed, and accuse Ethicon of failing to provide patients and doctors with adequate warnings regarding the risk of serious transvaginal mesh complications, including mesh erosion, chronic pain, infection, and scarring.
Court records indicate that the Ethicon litigation is just one of six proceedings underway in the Southern District of West Virginia, where more than 30,000 vaginal mesh lawsuits are now pending. Bernstein Liebhard LLP partner, Jeffrey S. Grand, has also been named to the Plaintiffs’ Steering Committees for proceedings involving American Medical Systems, Inc. (MDL No. 2325);Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187).
Mr. Grand has also been appointed Co-Liaison Counsel for two consolidated litigations currently underway in New Jersey’s Atlantic County Superior Court for vaginal mesh lawsuits involving C.R. Bard and Ethicon products. In addition, Mr. Grand served on the Plaintiff's trial team in the first Ethicon trial in that proceeding, which ended in March with an $11 million verdict for a woman who suffered transvaginal mesh complications due to a Gynecare Prolift device.
