Federal Judge Dismisses More than 20 Cases Filed by New Zealand Plaintiffs in Ethicon Transvaginal Mesh Lawsuit Litigation, Bernstein Liebhard LLP Reports
New York, NY (PRWEB) February 18, 2014 -- More than 20 cases filed by plaintiffs in New Zealand have been dismissed from the federal Ethicon transvaginal mesh lawsuit (http://www.transvaginalmeshlawsuithelp.com/) litigation, Bernstein Liebhard LLP reports.
According to court documents, the federal judge overseeing claims in the U.S. District Court for the Southern District of West Virginia ruled on February 14, 2014 that the plaintiffs’ home country would serve as an “adequate alternative forum” for these particular cases, as this is where most of the anticipated evidence and witnesses will be located. Federal Judge Joseph R. Goodwin also found that New Zealand is committed to regulating pelvic mesh products marketed and sold there.
In a motion originally filed by Ethicon Inc. to dismiss the cases, which were involved in a proceeding that now includes thousands of claims over its transvaginal mesh implants, court records show that the company pointed to the forum non conveniens doctrine. Transvaginal Mesh Lawsuits

This lawsuit alleges injuries caused by the company’s TVT Retropubic sling, court documents indicate.
These cases were filed by women who allege serious complications stemming from Ethicon’s pelvic mesh implants, which they say the company failed to warn about in their marketing and manufacturing of the devices. Plaintiffs further allege that Ethicon mesh was designed defectively.
In addition to cases filed in West Virginia federal court, thousands of Ethicon lawsuits over its line of Gynecare implants have also been consolidated in New Jersey Superior Court. Mr. Grand is actively serving as Co-Liaison Counsel in this proceeding, and was a member of the plaintiff’s trial team in a hearing that concluded in March 2013 with an $11 million damage award to a Gynecare Prolift recipient.
