Plaintiffs who have filed transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) against Johnson & Johnson’s Ethicon, Inc. unit and Boston Scientific Corp. in a mass tort proceeding underway in the Philadelphia Court of Common Pleas have asked the Court to allow their claims to remain in Pennsylvania, Bernstein Liebhard LLP reports. According to a Brief filed on February 11th, the companies have been seeking to have scores of cases filed by out-state plaintiffs dismissed from the proceeding. “Both companies contend that the vaginal mesh lawsuits should be dismissed from the Pennsylvania proceeding because the plaintiffs have no connection to the state. But in their February 11th brief, plaintiffs argue that both Johnson & Johnson and Boston Scientific have voluntarily registered to do business in Pennsylvania, and as such their transvaginal mesh lawsuits should be subjected to jurisdiction in Pennsylvania courts,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. According to court documents, the transvaginal mesh lawsuits pending against Boston Scientific and Ethicon are among more than 70,000 that have been filed in U.S. courts on behalf of women who allegedly suffered serious complications due to devices used in the treatment of pelvic organ prolapse and stress urinary incontinence. Mr. Grand is also serving on the Plaintiffs’ Steering Committees in the remaining litigations underway in the Southern District of West Virginia: In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In Re: Coloplast Corp.
