Transvaginal Mesh Lawsuits Progress Against American Medical Systems, Bernstein Liebhard LLP Reports

Court documents indicate that more than 10,000 vaginal mesh lawsuits have been filed against American Medical Systems in the Southern District of West Virginia, where multidistrict litigations have been established for similar claims involving a number of other manufacturers. Bard, Inc., (MDL No. 2187), and In re: Ethicon, Inc. (MDL No. 2327).
Mr. Grand has also been named Co-Liaison Counsel in two consolidated litigations established for C.R. Bard and Ethicon transvaginal mesh lawsuits that are currently underway in New Jersey’s Atlantic County Superior Court. He was also a member of the trial team on the first Ethicon trial in that proceeding, which ended in March with an $11 million verdict for the Plaintiff. Transvaginal mesh lawsuits have been mounting since October 2008, when the U.S. Food & Drug Administration (FDA) issued a Public Health Alert revealing that it had received 1,000 reports of serious injuries associated with vaginal mesh products over a three year period. In July 2011, the FDA warned that complaints associated with transvaginal prolapse repair had grown five-fold since the 2008 alert, and stated that it no longer considered these types of injuries to be rare. According to the agency, the most common vaginal mesh complications included chronic infections, organ damage, and mesh erosion and shrinkage.
