Tylenol Lawsuit News: Bernstein Liebhard LLP Comments on Scheduling of First Bellwether Trial in Federal Tylenol Litigation
New York, New York (PRWEB) February 08, 2015 -- Tylenol lawsuits (http://www.tylenollawsuitcenter.com/) filed on behalf of individuals who allegedly suffered acetaminophen-induced liver damage continue to move forward in the federal multidistrict litigation underway in U.S. District Court, Eastern District of Pennsylvania. According to a Case Management Order issued on January 29th, the proceeding’s first bellwether trial will commence on June 22, 2015. The case selected for trial was brought by the sister of a woman who died as a result of acute liver failure, allegedly due to the acetaminophen in Extra Strength Tylenol. (In Re: Tylenol (Acetaminophen) Marketing, Sales Practices and Products Liability Litigation, MDL No. 2436)
“Bellwether trials are a vital part of large, complex litigations such as the one involving Tylenol. The outcome of this case may provide valuable insight into jury rulings in other Tylenol lawsuits involving liver damage allegations,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The Firm is offering free legal reviews to consumers who were allegedly harmed by a Tylenol-brand over-the-counter medication.
Tylenol Litigation
According to court documents, more than 160 Tylenol liver damage claims are currently pending in the litigation underway in Pennsylvania, all of which allege that Johnson & Johnson and McNeil Consumer Healthcare failed to provide consumers with adequate warnings regarding the risks associated with Tylenol-brand medications. Among other things, the lawsuits claim that liver damage related to Tylenol products can occur even when the medication is used in accordance with label directions, and can be severe enough to result in hospitalization, liver transplantation, or death.
Last Fall, a Consumer Reports investigation revealed that acetaminophen-induced liver damage sends more than 80,000 people to the emergency room every year. Among other things, the report detailed one study which suggested that exceeding just 4,000 milligrams of acetaminophen for just a few days can result in serious liver problems and other complications. Yet the daily limits recommended for many over-the-counter acetaminophen products come very close to this threshold.*
In August 2013, McNeil Consumer Healthcare announced that it would add new, more prominent warnings regarding the risk of liver damage to the labels of Tylenol-brand medications. However, according to Bloomberg.com, over-the-counter Extra Strength Tylenol caplets each contain 500 mg of acetaminophen, which is higher than the current limits set by federal health regulators for prescription medications that contain this active ingredient.**
Individuals who suffered serious liver damage allegedly related to the acetaminophen in a Tylenol medication may be entitled to compensation for their injury-related damages.
