New Order Issued in GYNECARE PROLIFT Transvaginal Mesh Lawsuit Consolidation Ensures Cases Move Forward, Rottenstein Law Group LLP Reports
(PRWEB) January 10, 2014 -- A Jan. 7 protective order issued in federal court in West Virginia will ensure that Ethicon GYNECARE PROLIFT vaginal mesh lawsuits move forward, according to court documents. The Rottenstein Law Group LLP, which maintains a GYNECARE PROLIFT informational website at http://www.gynecareproliftmeshlawsuit.net, explains Judge Joseph R. Goodwin’s order for those who have filed or are looking to file vaginal mesh lawsuits.
Nonparties who were served with subpoenas to produce documents can now designate those documents as “Confidential/Highly Confidential,” according to the order (In re: Ethicon, Inc., Pelvic Repair System Products Liability Litigation; MDL-2327, U.S. District Court for the Southern District of West Virginia).
There are currently almost 12,000 Ethicon lawsuits pending in a consolidation of federal court cases, referred to as a “multidistrict litigation,” according to court documents. Federal vaginal mesh lawsuits involving six different manufacturers were all consolidated into U.S. District Court before Goodwin for the purpose of pretrial efficiency.
“The documents will be protected, only to be viewed by lawyers,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “With a protective order in place, the nonparties can be assured of the continued confidentiality of the documents demanded. Now they can produce the documents, discovery can continue and the lawsuits can move along.”
Bellwether trials are planned for 2014, with the first scheduled to begin on Feb. 10, according to court documents.
Settlements
There has already been at least one Ethicon trial in state courts. In March 2013, a jury awarded more than $11 million to plaintiff Linda Gross in New Jersey Superior Court, according to court documents (Gross v. Gynecare Inc., Atl-L-6966-10, Superior Court of Atlantic County, New Jersey).
There are five MDL defendants, except for Ethicon, who are reportedly considering vaginal mesh settlements, according to a Sept. 30 Bloomberg article.*
Women are filing transvaginal mesh lawsuits alleging they suffered injuries such as pain, discomfort and the erosion of the mesh implant, according to court documents. There are more than 40,000 transvaginal mesh injury lawsuits pending in the six MDLs, according to court documents.
