Federal C.R. Bard Vaginal Mesh Lawsuits Move Forward, As Court Grants Defense Motion to Amend Responses to Master Complaint

Bard, Inc. continue to move forward in the multidistrict litigation underway in U.S. District Court, Southern District of West Virginia, where Bernstein Liebhard partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee. According to an Order dated March 24th, the Court has granted certain defendants named in those lawsuits leave to amend their responses to the Plaintiffs’ Master Long Form Complaint. The Order further notes that the Court will convene a Scheduling Conference in the matter on April 9th at 10:00 a.m. (In Re: C.R. Transvaginal Mesh Litigation
Court documents indicate that more than 10,600 transvaginal mesh lawsuits have been filed against C.R. Bard in the Southern District of West Virginia. All of the lawsuits similarly allege that the company’s surgical mesh products used in the treatment of pelvic organ prolapse and stress urinary incontinence were defectively designed and manufactured. Plaintiffs further allege that the company failed to warn patients and the medical community of the devices’ propensity to cause mesh erosion, chronic pain, organ damage and other debilitating vaginal mesh complications.
According to court records, the federal C.R. Bard litigation is just one of seven vaginal mesh proceedings currently underway in the Southern District of West Virginia. In addition to his work in the C.R. Bard matter, Mr. Grand is also serving on the Plaintiffs Steering Committee for the remaining litigations: In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In Re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; In Re: Coloplast Corp. Pelvic Repair Systems Products Liability Litigation - MDL No. 2327; and In Re: Neomedic Pelvic Repair System Products Liability Litigation - MDL No. 2511.
Mr. Grand was also appointed Co-Liaison Counsel in a multicounty litigation established for C.R. Bard mesh lawsuits in New Jersey Superior Court. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10) He is also serving in the same capacity in a second New Jersey multicounty litigation for vaginal mesh lawsuits filed against Ethicon. In addition, Mr. Grand was a member of the Plaintiff’s trial team for that proceeding’s first jury trial, which ended in March 2013 with an $11 million verdict for a woman who was injured by Ethicon’s Gynecare Prolift device.
