Bard, Inc. and Ethicon, Inc. will convene the litigations’ next Case Management Conferences on May 7, 2015 at 12:00 p.m. Court records indicate that the proceedings will address the progress of product liability claims filed in Bergen County Superior Court on behalf of women who allegedly sustained serious vaginal mesh complications following the implantation of surgical mesh devices marketed by C.R. Bard and Ethicon. Bernstein Liebhard LLP Partner, Jeffrey S. Grand, is serving as Co-Liaison Counsel in both of the proceedings underway in Bergen County. Nationwide Vaginal Mesh Litigations
Court documents indicate that more than 9,000 transvaginal mesh lawsuits are currently pending in the two multicounty litigations now underway in Bergen County Superior Court. This includes 1,730 cases filed in the C.R. Bard proceeding, and more than 7,700 claims included in the litigation involving Ethicon. All of the lawsuits similarly allege that the companies’ surgical mesh devices used to treat pelvic organ prolapse and stress urinary incontinence were defectively designed and manufactured, and put women at risk for mesh erosion, chronic pain, organ damage and other debilitating vaginal mesh complications. Plaintiffs further allege that C.R. Bard and Ethicon did not adequately test their devices before bringing them to market, and failed to provide patients and the medical community with sufficient warning regarding their risks.

In addition to his appointment as Co-Liaison Counsel for both New Jersey transvaginal mesh litigations, Mr. Grand also served on the Plaintiff’s team during the first trial convened in the Ethicon proceeding. Court records indicate that the trial concluded in March 2013, with the jury awarding more than $11 million in compensatory and punitive damages to a woman who was injured by Ethicon’s Gynecare Prolift device.
