Vaginal Mesh Lawsuit News: Court Overseeing Federal Ethicon Lawsuits Issues Rulings Pertaining to First Bellwether Trial, Bernstein Liebhard LLP Reports

According to an Order filed in the U.S. District Court, Southern District of West Virginia on February 5th, Judge Joseph Goodwin has ruled that the defense will be allowed to introduce mesh complication rates that are drawn from reliable statistical methods and/or peer-reviewed literature. Judge Goodwin also granted a defense motion to exclude evidence of other TVT transvaginal mesh lawsuits, as it could unduly prejudice, mislead or confuse the jury. (Lewis, et al. v. Ethicon Transvaginal Mesh Lawsuits
Ethicon, Inc., a division of Johnson & Johnson, is facing over 15,000 vaginal mesh lawsuits that have been filed in the multidistrict litigation underway in West Virginia, where Bernstein Liebhard LLP partner, Jeffrey S. According to court documents, the litigation’s first bellwether trial began on February 10th, and involves a woman who allegedly suffered serious transvaginal mesh complications due to Ethicon’s TVT Retropubic sling. Bellwether trials are important milestones in large, complex litigation’s, as they often provide insight into how juries might decide similar claims. The nation’s first trial of a transvaginal mesh lawsuit involving an Ethicon device concluded in March 2013, with a New Jersey Superior Court jury awarding more than $11 million in compensatory and punitive damages to a woman who suffered serious vaginal mesh complications due to the company’s Gynecare Prolift device. Mr. Grand was a member of the plaintiff’s trial team, and is also serving as Co-Liaison Counsel in the New Jersey Ethicon litigation. Mr. Grand was also appointed to the Plaintiffs’ Steering Committees in three other federal vaginal mesh proceedings currently underway in the Southern District of West Virginia, including: American Medical Systems, Inc.
