Ethicon Vaginal Mesh Lawsuit News: Federal Court Issues New Order Pertaining to Bellwether Trials in Ethicon Transvaginal Mesh Litigation

On June 23rd, the Court issued an Amended Docket Control Order pertaining to the litigation’s second round of bellwether trials, which is scheduled to begin on August 25, 2014. Transvaginal Mesh Lawsuits
Court documents indicate that nearly 19,000 transvaginal mesh lawsuits have been filed in the Southern District of West Virginia against Ethicon and Johnson & Johnson. According to court filings, all of the complaints pending in West Virginia similarly allege that Ethicon's pelvic mesh products used in the treatment of pelvic organ prolapse and stress urinary incontinence were defectively designed and manufactured, causing recipients to suffer mesh erosion, chronic pain, organ damage and other serious, and sometimes permanent, vaginal mesh complications. The lawsuits further accuse the defendants of failing to warn doctors and patients of these risks.
Ethicon and Johnson & Johnson have also been named defendants in at least 5,079 vaginal mesh lawsuits that have been filed in a multicounty litigation now underway in New Jersey's Atlantic County Superior Court. Mr. Grand has also been named Co-Liaison Counsel in that proceeding, and served on the Plaintiff's team in its first trial involving an Ethicon lawsuit. In addition to his work on the Ethicon proceedings, Mr. Grand is also serving on the Plaintiffs’ Steering Committee for several other federal vaginal mesh proceedings underway in the Southern District of West Virginia, including: American Medical Systems, Inc. (MDL No. 2325); Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187).
