New York, New York (PRWEB) June 24, 2014
Vaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/) filed against Johnson & Johnson’s Ethicon, Inc. unit continue to move forward in a multidistrict litigation underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. On June 23rd, the Court issued an Amended Docket Control Order pertaining to the litigation’s second round of bellwether trials, which is scheduled to begin on August 25, 2014. Among other things, the Order notes that a Pretrial Conference will be convened on August 7, 2014 at 5:30 p.m. (In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2327)
“Our Firm has filed hundreds of vaginal mesh lawsuits on behalf of women who were allegedly injured by pelvic mesh devices manufactured by Ethicon and other companies. We look forward to the start of this trial, as the jury’s verdict could provide insight into possible outcomes in similar cases,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm is currently offering free legal evaluations to women who allegedly suffered mesh erosion, pain, scarring, infection and other serious injuries following the implantation of surgical mesh to treat pelvic organ prolapse or stress urinary incontinence.
Transvaginal Mesh Lawsuits
Court documents indicate that nearly 19,000 transvaginal mesh lawsuits have been filed in the Southern District of West Virginia against Ethicon and Johnson & Johnson. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs' Steering Committee in the federal Ethicon litigation.
According to court filings, all of the complaints pending in West Virginia similarly allege that Ethicon's pelvic mesh products used in the treatment of pelvic organ prolapse and stress urinary incontinence were defectively designed and manufactured, causing recipients to suffer mesh erosion, chronic pain, organ damage and other serious, and sometimes permanent, vaginal mesh complications. The lawsuits further accuse the defendants of failing to warn doctors and patients of these risks.
Ethicon and Johnson & Johnson have also been named defendants in at least 5,079 vaginal mesh lawsuits that have been filed in a multicounty litigation now underway in New Jersey's Atlantic County Superior Court. Mr. Grand has also been named Co-Liaison Counsel in that proceeding, and served on the Plaintiff's team in its first trial involving an Ethicon lawsuit. That case concluded in March 2013, when the Plaintiff was awarded more than $11 million for injuries she suffered from Prolift mesh. (In re: Pelvic Mesh/Gynecare Litigation, No. 6341-1)
In addition to his work on the Ethicon proceedings, Mr. Grand is also serving on the Plaintiffs’ Steering Committee for several other federal vaginal mesh proceedings underway in the Southern District of West Virginia, including: American Medical Systems, Inc. (MDL No. 2325); Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187). He was also named Co-Liaison Counsel in a second litigation underway in Atlantic County Superior Court for lawsuits involving C.R. Bard products. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10)
Women who suffered serious vaginal mesh complications allegedly due to products manufactured by Ethicon or another company could be entitled to compensation. About Bernstein Liebhard LLP
Bernstein Liebhard LLP is a New York-based law firm exclusively representing injured persons in complex individual and class action lawsuits nationwide since 1993. As a national law firm, Bernstein Liebhard LLP possesses all of the legal and financial resources required to successfully challenge billion dollar pharmaceutical and medical device companies. As a result, our attorneys and legal staff have been able to recover more than $3 billion on behalf of our clients. The Firm has been named by The National Law Journal to the Plaintiffs’ Hot List, recognizing the top plaintiffs firms in the country, for the past 12 consecutive years. Bernstein Liebhard LLP is the only firm in the country to be named to this prestigious list every year since it was first published in 2003.
Bernstein Liebhard LLP represents the victims of defective drugs and medical devices on a contingency-fee basis, and our clients are never expected to pay attorneys fees unless their case results in a successful recovery on their behalf. New York State’s contingency fee cap rules generally limit those fees to 33 1/3% of the total recovery. As a result, the Firm’s fees can be significantly lower than those assessed by attorneys in other states, which depending on the law may amount to as much as 40% or more of a plaintiff’s recovery.
