C.R. Bard Vaginal Mesh Lawsuits Move Forward, With Issuance of New Pretrial Order in Federal Multidistrict Litigation, Bernstein Liebhard LLP Reports

According to an Order dated July 30th, the federal judge overseeing thousands of such cases in the U.S. District Court, Southern District of West Virginia, has established new discovery procedures aimed at further streamlining the litigation process. At the conclusion of the pre-trial proceedings outlined in the Order, the Court will transfer each directly-filed case to a federal district of proper venue, while the vaginal mesh lawsuits transferred by the to the Southern District of West Virginia U.S. Judicial Panel on Multidistrict Litigation will be remanded to the federal district where they were originally filed. Vaginal Mesh Lawsuits
Court documents indicate that C.R. Bard is named a defendant in more than 9,000 vaginal mesh lawsuits that are pending in the Southern District of West Virginia. All of the lawsuits claim that surgical mesh devices marketed by the company to treat pelvic organ prolapse and stress urinary incontinence caused recipients to suffer serious transvaginal mesh complications, including chronic pain, mesh erosion, scarring and organ damage. The claims further allege that C.R. Bard failed to subject its transvaginal mesh devices to appropriate testing in order to ensure their safety and effectiveness.
In addition to his work on the federal multidistrict litigation involving C.R. Bard, Bernstein Liebhard partner, Jeffrey S.
