According to a Pretrial Order issued on December 11, 2013, the judge overseeing the proceeding has established the trial order for its first four bellwether cases. Court documents indicate that more than 12,000 vaginal mesh lawsuits have been filed against American Medical Systems in the federal litigation underway in West Virginia. All of the claims allege that recipients of the company’s pelvic mesh devices used to treat pelvic organ prolapse and stress urinary incontinences suffered painful and debilitating vaginal mesh complications.
The American Medical Systems litigation is just one of several established in the Southern District of West Virginia for transvaginal mesh lawsuits. Bernstein Liebhard LLP partner, Jeffrey S. According to court documents, vaginal mesh lawsuits began to mount after the U.S. Food & Drug Administration (FDA) issued a Public Health Alert in October 2010 regarding the risk of serious injuries associated with transvaginal mesh devices. In 2011, the FDA issued a second alert, warning that it no longer considered vaginal mesh complications associated with the use of pelvic mesh in prolapse repair to be rare.
