Transvaginal Mesh Lawsuit News: Bernstein Liebhard LLP Notes Report of First Vaginal Mesh Settlements in Canada

In recent months, a number of trials have concluded in the federal transvaginal mesh litigations underway in the Southern District of West Virginia. On November 20, 2014, a jury hearing a claim filed against Boston Scientific awarded the plaintiffs a total of $18.5 million, including $4 million in punitive damages, after finding that the company did not provide sufficient warnings about risks associated with its Obtryx bladder sling . A week prior, a jury hearing a case involving Boston Scientific’s Pinnacle Pelvic Floor Repair Kit awarded more than $26 million to four women who were injured by that device. (Enhnayem, et al. v. In September 2014, the federal Ethicon litigation’s second bellwether case concluded with an award of $3.27 million to a woman who suffered serious vaginal mesh complications due to the erosion of the Ethicon TVT-O Mesh sling. (Huskey v. Ethicon, Inc. et al, Case No. No. 2:2012cv05201)
The first federal trial of a C.R. Bard transvaginal mesh lawsuit concluded in the Southern District of West Virginia in August 2013, with the plaintiff being awarded $2 million for injuries caused by the company’s Avaulta mesh product.(Cisson v. C.R. Bard Inc., 11-cv-00195, U.S. District Court)
