As thousands of transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) continue to move forward in U.S. courts, Bernstein Liebhard LLP notes that dozens of similar claims have reportedly been settled in Canada. According to CTV.com, about 35 Canadian women have resolved their cases, all of which were filed after the plaintiffs allegedly experienced pain and internal damage following mesh surgery to treat stress urinary incontinence or pelvic organ prolapse. While the companies involved and the amounts of the vaginal mesh settlements have not been disclosed, Canadian attorneys are calling the accords a victory for the thousands of women who allegedly experienced similar transvaginal mesh complications.*

In recent months, a number of trials have concluded in the federal transvaginal mesh litigations underway in the Southern District of West Virginia. On November 20, 2014, a jury hearing a claim filed against Boston Scientific awarded the plaintiffs a total of $18.5 million, including $4 million in punitive damages, after finding that the company did not provide sufficient warnings about risks associated with its Obtryx bladder sling . (Tyree v. Boston Scientific Corp., No. 12-cv-8633). A week prior, a jury hearing a case involving Boston Scientific’s Pinnacle Pelvic Floor Repair Kit awarded more than $26 million to four women who were injured by that device. (Enhnayem, et al. v. In September 2014, the federal Ethicon litigation’s second bellwether case concluded with an award of $3.27 million to a woman who suffered serious vaginal mesh complications due to the erosion of the Ethicon TVT-O Mesh sling. (Huskey v. Ethicon, Inc. et al, Case No. No. 2:2012cv05201)
The first federal trial of a C.R. Bard transvaginal mesh lawsuit concluded in the Southern District of West Virginia in August 2013, with the plaintiff being awarded $2 million for injuries caused by the company’s Avaulta mesh product.(Cisson v. C.R. Bard Inc., 11-cv-00195, U.S. District Court)
In addition to his work on the federal mesh litigations, Bernstein Liebhard LLP Partner, Jeffrey S. Grand, was also appointed Co-Liaison Counsel in two consolidated proceedings established for C.R. Bard and Ethicon mesh lawsuits in New Jersey Superior Court.
