C.R. Bard Vaginal Mesh Lawsuits Move Forward, as Federal Judge Orders Parties to Select 200 Cases for Discovery, Bernstein Liebhard LLP Reports
New York, NY (PRWEB) March 30, 2014 -- The federal litigation underway in West Virginia for C.R. Bard transvaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/ ) continues to move forward, Bernstein Liebhard LLP reports. According to an Order issued on March 25, 2014, U.S. District Judge Joseph Goodwin of the Southern District of West Virginia has directed the parties to select 200 claims for case specific discovery in preparation for the proceeding’s second wave of bellwether trials. Depositions in these claims will be completed by October 3, 2014, and expert discovery is to conclude by January 5, 2015. The second wave of bellwether trials is expected to begin in early 2015. Vaginal Mesh Lawsuits
According to court documents, more than 8,000 claims have been filed in the Southern District West Virginia on behalf of women who allegedly developed painful vaginal mesh complications due to products manufactured by C.R. Bard. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is a member of the Plaintiffs' Steering Committee in the federal proceeding. The final trial in the first wave of bellwether cases is scheduled to begin May 19, 2014, and will involve a vaginal mesh lawsuit filed by a woman who was allegedly injured by an Avaulta device. The proceeding’s first bellwether trial concluded in August, and resulted in an award of $2 million in compensatory and punitive damages to another Avaulta plaintiff. (Cisson v. C.R. Bard Inc., 11-cv-00195)
One trial involving an Avaulta mesh lawsuit concluded in state court in July 2012. According to court documents, the California Superior Court jury hearing the case ordered C.B. Bard to pay $3.6 million of a $5.5 million judgment awarded to the victim of vaginal mesh complications caused by Avaulta pelvic mesh. The woman’s physician was ordered to pay the remaining portion of the judgment. (Scott v. Kannappan, S-1500-CV-266034-WDE, Superior Court for Kern County, California (Bakersfield))
According to court documents, at least 40,000 transvaginal mesh lawsuits have been filed in the Southern District of West Virginia against a number of pelvic mesh manufacturers.
