“Family Reunification is the process of returning children in temporary out-of-home care to their families of origin. Cases such as these can be quite tricky because of the high emotion in the courtroom,” said Davis, one of California’s premier juvenile dependency attorneys. “In some instances, the children involved are even coached into making accusations against their own parents that don’t seem accurate and attorneys are asked to argue the case based on CPS reports without calling any witnesses.”
The problem with this, according to Davis, is that Appellate Courts in California have ruled that an attorney’s argument is not evidence; therefore, just arguing leaves the clients with no evidence presented on their part. Also, CPS has its reports, so by definition the parents will most likely lose the trial.
Davis further stated that attorneys in such cases are also frequently asked to cut the number of witnesses they plan to call based on something called “stipulated” testimony, where the attorneys agree in writing to what is going to be testified to by the witness. However, Davis said, this is usually something he never agrees to, or rarely recommends.
“The moral of the story is, if you’re going to trial in a case involving FR, call witnesses to the stand and present documentary evidence to the judge,” said Davis. “You have every right to fight for your children with whatever means necessary under the law.”
