This Wright hip lawsuit is of great interest to our firm, as the allegations put forth by these plaintiffs echo much of what we have heard from our own clients.
New York, New York (PRWEB) February 01, 2014
Wright hip lawsuits (http://www.consumerinjurylawyers.com/wright-profemur-hip-replacement) that allege injury due to the Wright Profemur Hip Replacement System continue to move forward in courts around the country, Bernstein Liebhard LLP reports. According to an Order dated January 29, 2014, U.S. District Judge Carol E. Jackson of the Eastern District of Missouri has denied a bid by the defense to dismiss a Wright Profemur hip lawsuit on the grounds that the complaint was “overlong and repetitive.” However, she did find that some of the warranty claims put forth by the Plaintiff were preempted by federal law. (Bohnenstiehl v. Wright Medical Group Inc., et al., No. 4:13-cv-853)
According to court documents, the Wright hip lawsuit was filed on behalf of an Illinois woman who received the Profemur hip in 2008 and allegedly experienced early failure of the device in 2012, resulting in revision surgery. She and her husband allege the Profemur implant she received was defective.
“This Wright hip lawsuit is of great interest to our firm, as the allegations put forth by these plaintiffs echo much of what we have heard from our own clients,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The Firm is actively filing Wright hip lawsuits, and continues to offer free legal evaluations to individuals who were allegedly injured due to Wright Profemur hips, as well as Wright Conserve hip replacements.
Wright Hip Lawsuits
According to court records, Wright Medical Group is currently facing a number of product liability claims involving the Profemur hip. Last March, a filing in the U.S. District Court, Northern District of California indicated a settlement had already been struck in at least one such lawsuit. (Tucker, et ux. v. Wright Medical Technology, Inc., et al., No. 4:11-cv-03086) In December, a settlement was reported in another Wright Profemur lawsuit that was set to go to trial in the U.S. District Court, Middle District of Georgia. (Courson, et ux. v. Wright Medical Technology, Inc., No. 5:12-cv-173)
Additional court filings show that more than 70 federally-filed Wright hip lawsuits have been filed against the company over its Conserve line of metal-on-metal hips, all of which are pending in a multidistrict litigation underway in U.S. District Court, Northern District of Georgia. All of these lawsuits claim that the metal-on-metal design of the Conserve products caused recipients to suffer metallosis, pseudotumor formation, failure of the hip, and other serious complications that often result in a need to surgically remove and replace the hip implant. (In re: Wright Medical Technology, Inc., Conserve Hip Implant Products Liability Litigation, MDL No. 2329)
Recipients of Wright Profemur hip replacements or Wright Conserve hips who allegedly suffered serious complications from their device may be entitled to compensation for medical bills, lost wages, pain and suffering and other damages.
