Wright Profemur Hip Lawsuits Move Forward, as Federal Judge Denies Bid to Dismiss Wright Profemur Hip Lawsuit, Bernstein Liebhard LLP Report

According to an Order dated January 29, 2014, U.S. District Judge Carol E. Jackson of the Eastern District of Missouri has denied a bid by the defense to dismiss a Wright Profemur hip lawsuit on the grounds that the complaint was “overlong and repetitive.” However, she did find that some of the warranty claims put forth by the Plaintiff were preempted by federal law. According to court documents, the Wright hip lawsuit was filed on behalf of an Illinois woman who received the Profemur hip in 2008 and allegedly experienced early failure of the device in 2012, resulting in revision surgery. She and her husband allege the Profemur implant she received was defective.

Additional court filings show that more than 70 federally-filed Wright hip lawsuits have been filed against the company over its Conserve line of metal-on-metal hips, all of which are pending in a multidistrict litigation underway in U.S. District Court, Northern District of Georgia. All of these lawsuits claim that the metal-on-metal design of the Conserve products caused recipients to suffer metallosis, pseudotumor formation, failure of the hip, and other serious complications that often result in a need to surgically remove and replace the hip implant.
