Wright Conserve Hip Lawsuits Move Forward, as Federal Court Issues Order Pertaining to Bellwether Trials, Bernstein Liebhard LLP Reports

According to an Order dated August 19th, the Court has established a bellwether trial program that would allow the litigation’s first case to go before a jury in March 2015. Wright Hip Lawsuits
According to court documents, nearly 400 Wright hip lawsuits have been filed in the multidistrict litigation underway in the Northern District of Georgia. All of the pending claims allege use of the Wright Conserve Total Hip Implant System, Conserve Total A-Class Advanced Metal Hip Implant System, and the Conserve Resurfacing System causedpainful and debilitating injures as a result of the accumulation of excessive metal ions generated by the implants.
In a regulatory filing dated August 5, 2014, Wright Medical disclosed that more than 800 product liability claims involving Conserve hip products have been filed in state and federal courts throughout the U.S. The filing also revealed that the company is participating in a non-binding mediation that has been established in the federal proceeding in Georgia. Wright Medical further stated that that the growing Conserve litigation is being driven by the ongoing negative publicity surrounding metal-on-metal hip implants.*
According to a safety communication issued by the U.S. Food & Drug Administration (FDA) in January 2013, metal-on-metal hip implants may be more vulnerable to early failure compared to devices made from other materials. The agency has advised patients fitted with all-metal hip implants to undergo metal ion blood testing if they experience pain, swelling, or other symptoms that could be an indication that their hip is failing. The FDA has also recommended stricter regulations for metal-on-metal hip implants, including a requirement that manufacturers of devices currently on the market conduct safety studies of their products if they plan to continue selling them.
Wright Medical also acknowledged in the August 5th regulatory filing that it is currently named a defendant in at least 36 lawsuits involving the Profemur hip replacement.*
