Wright Conserve Hip Lawsuit Defendant Seeks Summary Judgment in Federal Claim, Bernstein Liebhard LLP Reports

According to a motion filed on January 9th, Wright Medical Group is seeking a summary judgment in one lawsuit pending in the proceeding. Among other things, the company asserts that, as a holding company, it had no involvement with the development of the Conserve hip system, and its only function is to hold the stock of Wright Medical Technology, Inc., which is also named as a defendant in the claim. Wright Hip Lawsuits
According to court documents, the case at issue in this motion was filed on behalf of a woman who allegedly suffered complications due to the Wright Conserve Thin Shell acetabular component and Conserve A-Class Total femoral head. The claim is one of nearly 400 that allege metal-on-metal hips included in the Conserve line caused plaintiffs to experience metallosis, pseudotumor formation, chronic pain, early device failure and other complications due to their propensity to shed toxic metal ions into recipients’ tissue and blood stream. In an Order issued on December 23, 2014, the Court scheduled the first bellwether trial of a Wright Conserve hip lawsuit for March 9, 2015. According to Bernstein Liebhard LLP, bellwether trials are important milestones in these types of consolidated litigations, as they may provide valuable insight into how juries will rule in similar claims.
In a regulatory filing dated August 5, 2014, Wright Medical disclosed that more than 800 product liability claims involving Conserve hip products have been filed in state and federal courts throughout the U.S. According to the company, it has also been named a defendant in some three dozen lawsuits involving its Wright Profemur hip replacement. Court records further indicate that settlements have been reached in a small number of those claims, including one Profemur lawsuit that was set to go to trial in the U.S. District Court, Middle District of Georgia in December 2012.
